These Terms of Service (the “Terms”) form a binding agreement between you and [COMPANY LEGAL NAME] (“we”, “us”, “our”), the operator of Throw (the “Service”), a darts league management platform available at treblo.co.uk and through related applications.

By creating an account or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, you must not use the Service.

01Definitions

  • “Account”: the account you create to use the Service.
  • “Content”: any data, text, names, statistics, fixtures, results, comments, or other materials submitted, generated, or stored through the Service.
  • “Free Trial”: the 30-day no-payment trial described in section 4.
  • “Plan”: the free tier or any paid subscription tier we offer.
  • “Subscription”: a recurring monthly paid plan as described in section 5.
  • “You”: the individual or organisation using the Service.

02Eligibility and account registration

To use the Service you must be at least 16 years old and capable of entering into a binding contract. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your Account. Notify us immediately at support@treblo.co.uk if you believe your Account has been compromised. Passwords must be at least 8 characters and are stored only in hashed form.

You may not register more than one Account per individual without our written permission, and you may not share your Account credentials with anyone else.

03The Service

Throw is a platform for managing darts leagues, teams, fixtures, matches, and player statistics. The exact features available to you depend on your Plan and may change over time as we improve the Service.

We may add, modify, or discontinue features. Where a change materially reduces the functionality of a paid Plan, we will notify you in advance and you may cancel your Subscription as set out in our Refund Policy.

04Free trial

When you sign up for a paid Plan you receive a 30-day Free Trial. During the Free Trial:

  • no payment is taken;
  • you have full access to the features of your chosen Plan;
  • you can cancel at any time, for any reason, with no further obligation.

If you do not cancel before the Free Trial ends, your chosen Plan will automatically convert to a paid monthly Subscription and the stored payment method will be charged the then-current monthly price. The Free Trial is a one-off offer per user.

05Subscriptions, fees and billing

Paid Subscriptions are monthly rolling. There is no minimum term and no contract obligation. You can cancel at any time and you will continue to have access until the end of your current paid month.

  • Price: the monthly price is [MONTHLY PRICE, e.g. £X.XX / €X.XX], exclusive of any applicable VAT or other taxes, which will be added where required by law.
  • Renewal: Subscriptions renew automatically each month on the same calendar day until cancelled.
  • Payment processor: payments are handled by Stripe. We do not store your full card details.
  • Failed payments: if a payment fails, we may retry the charge or downgrade your Account to the free tier until payment is received.
  • Price changes: we may change pricing on at least 30 days' written notice (by email or in the Service). If you do not agree, you may cancel before the new price takes effect.

Refunds, free-trial mechanics, and the EU/UK statutory right of withdrawal are dealt with in our Refund Policy.

06Cancellation

You may cancel your Subscription at any time through the Service, the Stripe billing portal, or by emailing billing@treblo.co.uk. Cancellation takes effect at the end of the current monthly cycle. After that date, your Account reverts to the free tier; we do not delete your historical data automatically.

We may suspend or terminate your Account if you breach these Terms, fail to pay fees due, use the Service unlawfully, or pose a risk to other users or to the Service. Where reasonable, we will give you notice and an opportunity to remedy the breach.

07Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent, deceptive, or harmful purpose;
  • attempt to gain unauthorised access to any part of the Service, other accounts, or our systems;
  • probe, scan, reverse-engineer, or attempt to extract source code from the Service, except to the extent permitted by law;
  • introduce viruses, worms, trojans, or any other malicious code;
  • scrape, harvest, or systematically extract data, except where expressly permitted by us;
  • upload Content that is illegal, infringing, defamatory, threatening, abusive, or which violates the privacy of others;
  • interfere with or disrupt the Service, or impose an unreasonable load on our infrastructure;
  • resell, sublicense, or commercially exploit access to the Service without our written consent.

We may remove Content that breaches these Terms and may suspend or terminate Accounts of users who do so.

08Your Content

You retain all ownership rights in the Content you submit to the Service. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display, adapt, and otherwise use it solely to operate, maintain, and improve the Service and to provide it to you and other users entitled to see it (for example, members of the same league or team).

You are responsible for your Content. You confirm that you have all rights necessary to submit it and that it does not infringe anyone else’s rights.

Content created collaboratively (such as league fixtures, results, and statistics) may be retained on the platform even if your Account is closed, where doing so is necessary to maintain the integrity of league records relied on by other users. Where possible, we will dissociate such records from your personal identifiers on request, in line with our Privacy Policy.

09Our intellectual property

The Service, including its software, design, text, graphics, logos, and the “Throw” name and brand, is owned by us or our licensors and is protected by copyright, trade mark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.

10Third-party services

The Service relies on certain third-party services, including (but not limited to) Stripe for payments and our hosting providers for infrastructure. Your use of those services may be governed by their own terms and privacy policies. We are not responsible for the acts or omissions of third parties.

11Availability and changes

We aim to keep the Service available 24/7 but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or events outside our reasonable control. We may update, modify, or discontinue parts of the Service at any time, subject to your statutory rights and the Refund Policy.

12Disclaimers

Except as expressly stated in these Terms and to the maximum extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant that it will be error-free, uninterrupted, secure, or fit for any particular purpose.

Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be limited or excluded under applicable law.

13Limitation of liability

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by law.

Subject to the above, and to the maximum extent permitted by law:

  • we are not liable for any indirect, special, incidental, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, or data;
  • our total aggregate liability to you arising out of or in connection with the Service in any 12-month period is limited to the greater of (i) the fees you paid us in that period and (ii) £100 / €100.

If you are a consumer, this clause does not affect your statutory rights.

14Indemnity (business users only)

If you are using the Service in the course of a trade, business, craft, or profession, you agree to indemnify us against all losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your Content, or your unlawful use of the Service.

15Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Please read it carefully.

16Changes to these Terms

We may update these Terms from time to time. Where changes are material, we will notify you by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you may cancel your Subscription as set out in our Refund Policy.

17Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of [COUNTRY OF REGISTRATION], without regard to its conflict-of-laws rules. The courts of [COUNTRY OF REGISTRATION] have exclusive jurisdiction, except that, if you are a consumer based in another country, you may also bring proceedings in the courts of your country of residence and benefit from the mandatory consumer-protection rules of that country.

18Miscellaneous

  • Entire agreement: these Terms, the Privacy Policy, and the Refund Policy together form the entire agreement between you and us regarding the Service.
  • Severability: if any provision of these Terms is held to be unenforceable, the remaining provisions remain in full effect.
  • No waiver: our failure to enforce any right is not a waiver of that right.
  • Assignment: you may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours in connection with a merger, acquisition, or sale of assets.
  • Notices: we may give notice to you by email to the address on your Account or through the Service. Formal notices to us must be sent to admin@treblo.co.uk.
